The Demise of the 28-Article Ceasefire Plan for Ukraine: Why Peace Negotiations Continue to Stumble

Europe experienced widespread relief on Monday, as the tension caused by the introduction of a new 28-point plan for ending the war appeared – momentarily – to have been defused. A American diplomat spoke of "notable headway" after diplomatic discussions in Geneva. On Monday night, the Kremlin made its retaliation: another massive barrage of missile and drone strikes on Kyiv.

The Rhythm of Diplomacy and Destruction

The chain of contrasting events captured the grim essence of the current period. By day, diplomatic battles are waged: positive announcements are released from different nations. Considerable effort is devoted on managing certain initiatives. By night, Russian leadership brutally reminds the world that, for them, military action persists as the key method for achieving "resolution".

Nocturnal Warfare

As Russia's attack unfolded into the early hours of Tuesday, the present situation of Ukraine's exposure was exposed. Ukraine is equipped to monitor rocket firings from across the border, a ability enabled by current data. From witness perspectives, military aircraft that had been deployed to engage hostile guided weapons flew past – modern combat jets provided to Ukraine by Western partners.

Moments later, Kyiv's anti-aircraft weapons engaged: several firings fired to intercept a Russian ballistic missile. This was a modern interception technology at work, presumably delivered by allied countries. Every firing shakes the surroundings, shaking the windows. The moment of terror quickly transforms into grim resignation: possibly the approaching threat won't strike its target this time, protecting urban areas from devastation and another blackout.

Continuous Dangers

Not long after, a heavy machine gun engaged a aerial vehicle somewhere nearby, part of a defensive team – most likely imported technology. Sadly, the shots failed to hit the enemy aircraft – it maintained course toward its objective.

Periodically, this continued until dawn. Kyiv greeted the morning news: seven people killed, damage and utility failures in numerous residences as a result of the evening attack. As customarily, everyone still maintained normal activities – experiencing conflict. But those entire period encapsulated Ukraine's vital need on external assistance – a reliance that European nations are evidently unprepared to replace in the short term.

Unsuccessful Negotiations

The 28-point plan from Washington sparked intense emotion, controversy and profound anxiety – and momentarily shifted focus from Ukraine's largest corruption scandal in years. Yet, we have seen this script before, after prior negotiation attempts and international summits.

Every new initiative from US leadership adheres to the consistent cycle: a diplomatic cavalry charge against Ukraine, which Kyiv, with partner nations, effectively counters. They manage the tension but never actually win the battle. This cycle will, no doubt, persist.

Tactical Assessments

It is easy to blame particular leaders of repeatedly advocating Kremlin's demands. But that does not seem to be the whole story. US administration functions according to a premise well known to seasoned negotiators: you cannot win at the negotiating table what you have lost on the battlefield. The US administration believes that it is unfeasible to force Russia to abandon the land that it already controls in Ukraine's south or east.

The challenge is that while recognising this factual reality, American administration does minimal to discourage Russia, through words or deeds, from assuming that the status quo will not change more in its benefit in the months ahead.

Divergent Views

Therefore, Russian leadership is certain that time is on his side – that Ukraine and its partners are approaching exhaustion. Their incentive to sign a deal that does not give them the maximum possible gain is close to zero. There may be many attempts to end hostilities, but they will persist as long as Russia's government remains highly assured in the outcome.

On the contrary, Kyiv believes that Ukraine can still endure, gradually sacrificing people and territory but averting a entire defensive failure until conditions improve in its advantage.

Existing Situation

Realistically, there are no actual prerequisites for a ceasefire. Now, subjective factors are becoming relevant: leadership ambitions to negotiate peace and obtain worldwide acknowledgment, and the government's double obstacles – on one hand, not to distance important partners, and on the other, to mobilize citizens around the country's interests against any plan Kyiv finds unworkable, so that their focus does not shift toward internal issues. And although their mission will now be much harder after recent developments, it remains highly unlikely that this will change their overall approach.

These two forces are driving the talks.

Summary and Prospects

It took a mere seven days to eliminate the proposed articles of the current initiative. Aggressive and erratic handling of the matter by Washington, opposition by Ukraine and the other European countries, along with soothing efforts of representatives, and finally, recent disclosures, all served their function.

While new proposals based on previous concepts are approaching, Kyiv, London and other European capitals should arrive at a critical understanding: Ukraine and Europe will only be able to resist negotiation assaults from Washington that are rooted in Kremlin requirements and reflect specific hesitation to change the course of events, if they remain united and strengthen their defence capabilities at a significantly accelerated rate. If they do, neither external pressure nor military threats will be able to defeat them. In the meantime, Ukraine's capability to defend against evening bombardments will, for the predictable period, largely rely on continued Western support.
